  • The bill proposed a fine of at least $500.00 and a probationary period to 6 months for first time offenders that refuse to take the breath test.
  • For those drivers facing a subsequent charge, the bill seeks to make installation of an interlock device mandatory and the charge one of a first degree misdemeanor when the driver refuses to submit to the breath test.

The goal is to make the laws on driving while intoxicated tougher, so more motorists will refrain from the activity. A possible flaw to this approach is that instances of DUI will continue to happen despite these changes. This can be seen by states where texting and driving have been made illegal, yet drivers continue to engage in the act.
