No one wants to go to jail, but that possibility exists for even some of the most minor offense. The thought that jail time is only part of a felony case is inaccurate, as there are some misdemeanors that carry a term of incarceration as part of their punishment. This does not mean that if you are charged with a crime that you will go to jail, but it does take a strategic defense for you to maintain your freedom. In a DUI case a successful defense is one that keeps you on the road and also out of jail.

The three most common DUI sentences in Florida include these requirements if you want to stay out of jail:

  • Agreeing to go on probation. This will mean you have to stay out of trouble for a set period of time. Staying out of trouble means you cannot get any new tickets, even a speeding ticket, or be arrested for a new crime. If you do get a ticket or get arrested your probation will be revoked and you will face time in jail. In addition to having your probation revoked you will have to defend the new charges and the charge of probation violation. This can be a tough pill to swallow and create the need for a much more aggressive approach to the defense of your case.
  • You will likely be required to have an interlock device installed in your car as part of the probation. An interlock is a device that prevents your car from starting until blown into. The purpose is to make sure you are not starting your car while under the influence. The goal is to prevent a driver from driving after drinking and is a common requirement for probation in a DUI case.
  • Signing up for driving school or going to Court ordered drug and/or alcohol school may be required in order for you to stay out of jail.

These three things might not sound like fun, but they will keep you out of jail if you are charged with DUI. Each case is different, so your case may have a few different requirements.
