A DUI is a serious matter. This means that you should give it a serious defense. The possible consequences include spending time in jail, having to pay high fines, and having your driver’s license taken away. Three popular DUI defense strategies, which work in a majority of cases, are:

  • Attacking the breath test results. Too many people accept the test results as final, but the truth is you can and should challenge these results. If the officer that administered the test was not trained to do so, the result should not stand. Likewise, if the machine was not functioning properly, or had not been maintained as recommended, the test result may not be reliable.

 

  • Negotiate a plea with the prosecution, which will probably require you to go on probation. During your probationary period, if you do the things required of you, you will benefit in the end. A common bargain includes agreeing to go on probation in exchange for a dismissal or reduction of the charges once the probationary period ends. You might have to have an interlock device installed in your car while on probation, go to DUI and/or drug school, and remain ticket free. But, if you are able to do these things, you can save harmful charges from being placed on your permanent record.

 

  • Take your case to trial, which is only recommended in a handful of cases. You will need convincing evidence if you go to trial, and doing so puts your future in someone else’s hands. We know this can be scary, but if your case is right for trial we will work hard for a satisfactory result.
