The law makes it a point to try and have punishments fit the crime. For example, if you are charged with DUI you will have to fight for your right to drive and also show that you are not drinking and driving by having an interlock installed in your car. An interlock is a device that prevents your car from starting if you have had too much to drink, as determined by you blowing into the device before turning the key. Other types of crimes have other forms of punishment, and even different terms of probation.

One classification of crime with significantly different probationary requirements than most other offenses is a crime that is defined as a sex crime. For sex offenders who are serving probation in lieu of jail time, here are five important things to know:

  • Sex offenders must abide by a curfew, and cannot be out beyond the time set for their curfew.
  • Sex offenders are not permitted to live within 1,000 feet of a school, daycare or park.
  • There is an annual requirement that a lie detector test be taken, with questions geared at identifying an instance of a repeat sex crime.
  • Sex offenders have to keep track of where they are driving, and are not allowed to drive alone unless their probation officer gives prior approval.
  • There is a prohibition against an offender viewing or accessing sexually explicit material.

Failing to abide by any of these things, or committing a new crime while on probation, will end with a revocation of the probation and a new charge being filed. Because some of the requirements while on probation are hard to understand, it is important to seek the assistance of a qualified criminal defense attorney when negotiating terms. For instance, is going to a movie with nudity a violation of the last requirement above? If so, a sex offender may risk a violation of probation simply by going to the theater.
