The range of punishment and the length of time for which you will lose your driver’s license when charged with DUI depends on the circumstances of each case. Some of the consequences are more severe than others, and it is good to know what you are up against if you have been charged with DUI. Understanding the possibilities also helps when developing a defense, or when considering a plea agreement from the State.

In a DUI case, there are typically four different possible punishments regarding your right to drive. The punishment that you will face depends on several factors. The breakdown of what to expect as far as your continued ability to drive when charged with DUI is as follows:

  • First time offenders can usually resolve their case by entering a term of probation that includes community service, installation of an interlock device, attendance at drug and/or alcohol classes, loss of driving privileges for 6 months to one year, or any combination of these things.
  • If you are facing a second conviction, you can lose your driver’s license for up to five years if the second offense takes place within five years of your first offense. For a third or subsequent offense the length of time for which you are unable to drive is longer. For instance, if you are looking at your third DUI charge, you can expect to lose your license for up to ten years if the third offense takes place within ten years of your second case.
  • A fourth DUI case will result in losing your license permanently.
  • If you are involved in an accident while drinking and driving that results in a death, you can also expect to have your license permanently taken from you.

Many cases for DUI can be resolved favorably, but this does not mean you will get everything you want. Depending on the number of cases you have had, the punishment will be more severe with each subsequent charge. We can help by examining the facts of your case and aggressively pursuing a solution that meets your needs.
