For most people, the idea of going to jail is scary. No one wants to spend time behind bars, where their everyday freedoms are nearly non-existent. Not only will going to jail mean that you are unable to do the things you enjoy doing, but you will also no longer be able to go to work and earn a living. This can work a real financial hardship on most families, so when criminal charges are brought and the possibility of jail time looms, it is critical to find a skilled defense attorney to help protect your freedom. With DUI cases, there is always the chance that the Court will order the defendant to jail, but there is just as good a chance that you will be eligible for an alternative to this dreadful possibility.

Florida law does allow for those charged with DUI to remain productive members of society, outside of the jailhouse walls. Two alternatives to a jail sentence for a DUI case include:

  • Agreeing to a term of probation, which usually requires the driver to attend DUI and/or other substance abuse programs, have an interlock installed in their vehicle, and stay out of trouble while on probation! This means you will not be allowed to receive any new tickets, or be arrested for a new crime. If you are arrested, your probation will be revoked and you will face the full range of punishment for the DUI case as well as be made to answer for the new charges.
  • An in house alcohol or drug treatment program can be ordered by the Court. In this instance, any time you spend in one or more of these types of programs counts as “credit” towards a jail sentence. This can reduce or eliminate all together the need to spend time incarcerated.
