  • The authorities no longer consider you to be under the influence of alcohol.
  • Your actions and behavior are in line with what is “normal” behavior for a persona that is not under the influence of alcohol or another substance.
  • Your BAC falls to a rate of 0.05% or lower.
  • It has been 8 or more hours since the time of your arrest.

 

Once you get out of jail, the time to being working on your defense begins. The first thing you will need to do is to make a request for an administrative review of your driver’s license suspension. There is a very short time frame within which to make this request, and if you fail to do so your driving privileges will be lost for a certain amount of time.
